These terms apply to anyone who creates or manages a store on GAWKIN ("you"). By creating a store you agree to them. GAWKIN ("we", "us") provides the software and hosting that run your store at gawk.in and any domain you connect.
1. Your account
- You must give accurate information when you sign up and keep your email address current.
- You are responsible for keeping your password safe and for everything done through your account.
- You must be at least 18 years old, or the age of majority where you live, to open a store.
2. Your store and your content
You own the products, photos, text and other content you add to your store. You give us permission to store, display and process that content only to run your store and the GAWKIN service. You confirm you have the right to use everything you upload, including photos and brand names.
3. Selling to your customers
- You are the seller in every sale made through your store. GAWKIN is not a party to the contract between you and your customers.
- You are responsible for your products, their descriptions and prices, delivery, returns, refunds, customer service, and for complying with consumer protection, e-commerce, tax (including GST) and other laws that apply to you.
- Customers pay you directly. GAWKIN does not collect, hold or transfer the money from your sales.
- You must publish clear policies for delivery, returns and refunds, and honour them.
4. Things you may not sell or do
You may not use GAWKIN to sell or promote anything illegal in India, including counterfeit or infringing goods, prohibited drugs, weapons, or adult content, or to mislead or defraud anyone. You may not attempt to break, overload or gain unauthorised access to the service, or use it to send spam. We may remove content or suspend stores that break these rules.
5. Plans, fees and trials
- Your plan sets limits such as the number of products, storage and whether you can connect a custom domain.
- New stores start with a free trial. When the trial ends, your store stays online but you will need an active plan to keep adding products and making changes.
- Fees for paid plans are shown to you before you pay. Fees exclude taxes, which are added where required.
- If a payment is overdue we may limit or pause your store after letting you know.
6. The service
We work to keep GAWKIN fast, secure and available, but we cannot promise it will never be interrupted. We may improve, change or retire features; if a change significantly reduces what you rely on, we will tell you in advance where we reasonably can.
7. Your data
How we handle personal information is explained in our privacy policy. You can export your orders at any time. When you collect your customers' personal information, you are responsible for using it lawfully.
8. Suspension and closing your store
You can stop using GAWKIN at any time; see our refund and cancellation policy. We may suspend or close a store that breaks these terms, puts customers or the service at risk, or is required to be taken down by law. Where possible we will warn you first and give you a chance to fix the problem.
9. Disclaimers and liability
GAWKIN is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
10. Changes to these terms
We may update these terms. If changes are significant we will notify you by email or in your dashboard before they take effect. Continuing to use GAWKIN after that means you accept the updated terms.
11. Governing law
These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute.
